Addressing Cases Of Fabricated Illness:
Emma Carey represented a father who was a Yemini national, who spoke very little English, and whose daughter was removed following allegations of Munchausen Syndrome by Proxy, with injuries being perpetrated to the child by the mother. The case involved complex issues of law as well as extremely delicate cultural issues. During the course of the proceedings the mother gave birth to a 2ndchild. We secured the return of both children to the father. Initially this was on the basis that the mother vacate the family home, however now both parents and children have been reunited as a family unit.

Handling Parents With Alcohol Abuse Issues:
Emma Carey represented a mother whose 3 year old child placed her 14 week old twins in the bath while she was asleep under the influence of alcohol. 1 of the twins  sadly died. The other suffered long-term physical and mental injuries. The 2 surviving children were put up for adoption; but this was successfully fought and it was ensured that they remain within the family and the mother maintained regular and consistent contact. The mother had various issues which she needed to address and she was directly worked with to encourage her to address those issues. A long-term pan was drawn up, by which successfully  an application will hopefully be made for the rehabilitation of the children to the mother’s care in the not-too-distant future.

Discharging of Care Orders Following Non-Accidental Injury Allegations:
Emma Carey represented the mother of a 9 month-old baby, presented at hospital with 6 broken ribs. The injuries were identified as Non-Accidental Injuries and the mother identified as the potential main perpetrator. We put together a package of care and supervision for the child within the family home which ensured that, although an Interim Care Order was made, the child was never removed from mother’s care. After a lengthy Finding of Fact hearing, no findings were made against the parents and the Care Order was discharged and the Local Authority’s with this family ceased.

Overturning Shaken Baby Allegations:
Emma Carey represented a mother in a shaken baby case in which Finding of Facts were made against the mother that she had caused the injuries to the child. We instructed Michael Keehan QC, to represent the mother in those proceedings which resulted in a return of the child to the mother under a Care Order. Subsequently a successful application was made for that Care Order to be discharged.
