This is where the Local Authority offer to accommodate a child where issues have arisen in relation to that child’s care. Section 20 Accommodation, is a voluntary agreement by the parents/carers of the child to allow the Local Authority to accommodate that child. The minute the Local Authority start mentioning Section 20 Accommodation you should consult with Solicitors. Many parents feel pushed to place their child into voluntary accommodation due to fears that the Local Authority will forcibly remove the child if they do not cooperate. If your child is accommodated under Section 20 Order the Local Authority does not have Parental Responsibility for that child and you can withdraw your consent at any time and ask for the child to be returned to your care. If you withdraw consent however, you run the risk the Local Authority might start Care Proceedings.
